The Office of the New Mexico’s State Engineer (“OSE”) issued its Draft Active Water Resource Management Regulations for the Lower Rio Grande basin in November, 2006. The draft regulations proposed to limit all irrigation farm delivery requirements in the Lower Rio Grande basin to 4.0 acre feet per acre. As a result, the New Mexico Pecan Growers (“NMPG”) entered into discussions with the OSE in an effort to secure the OSE’s recognition that established pecan orchards have historically used, and continue to need, water in excess of 4.0 acre feet per acre on an annual basis. After seventeen months of negotiation, NMPG and its individual board members have entered into a settlement agreement with the Office of the New Mexico State Engineer regarding the water needs for pecans. You can read and print a copy of the Settlement Agreement here. The Agreement will be filed with the Lower Rio Grande water rights adjudication court for approval. If approved by the court, owners of existing pecan orchards who have signed the agreement will be adjudicated a farm delivery requirement of 5.5 acre feet per acre to irrigate their orchards. The water requirements for all pecan orchards will be determined by the Lower Rio Grande adjudication court. The Board of Directors of NMPG believes the Settlement Agreement is an important first step towards securing the future water needs for pecans. Governor Bill Richardson has followed the development of the Settlement Agreement. He commends the work of both the NMPG and the State Engineer in resolving the water needs for pecans. He intends to add his signature of approval to the agreement as soon as a sufficient number of pecan growers sign. NMPG strongly recommends that you carefully review the terms of the Settlement Agreement and to seek independent legal advice, if necessary, before attending any of the above work sessions to sign the agreement.
